Welcome to www.hyperrealacademy.com and any related websites that link to these Terms (collectively, the “Website”), owned and operated by Hyper Real Academy LLC (“Hyper Real Academy,” “we,” “us,” or “our”). Except as otherwise noted herein, these terms and conditions (the “Terms”) govern your use of the Website, Hyper Real Academy’s services, content, educational programs, and the purchase, receipt, or use of any products or materials made available through the Website (collectively, the “Site” and “Product(s)” respectively).

PLEASE READ THESE TERMS CAREFULLY. YOUR ACCESS TO OR USE OF THE SITE OR PURCHASE OF PRODUCTS CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SITE OR PURCHASE ANY PRODUCTS.

These Terms include a mandatory arbitration and class action waiver provision, requiring individual arbitration to resolve disputes, rather than jury trials or class actions. Hyper Real Academy may update or revise these Terms at any time, in its sole discretion. Notice of such changes may be provided via email or through the Site. Continued access or use of the Site after notice constitutes your acceptance of the revised Terms.

1. 1. Account Creation & Eligibility. You must be able to form a binding contract to use the Site. By registering for an account, you agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
   2. Terms of Sale. 
      • Orders, Pricing, and Payments. Hyper Real Academy strives to maintain accurate information but is not responsible for typographical errors or outdated content. Product prices, availability, and color representation may vary. Orders are subject to cancellation at our discretion.
      • Quantity Limitations and Resellers. We reserve the right to limit quantities or refuse sales. Products purchased may not be resold or exported. For purposes of these Terms, a “reseller” is anyone who purchases a product(s) from the Site for the purpose of engaging in a commercial sale of that same product(s) to a third party. Products you purchase may not be resold or exported; your purchase may not be sold, leased, or transferred to restricted countries, restricted end users, or for restricted end uses according to U.S. export and sanctions laws.
      • Shipping & Taxes. You agree to pay any shipping and handling charges shown at the time you make a purchase. Shipping charges will be shown at checkout. Taxes will be collected as applicable. Please consult our FAQ for details.
      • Returns & Exchanges. Refer to our FAQ page for information about returns and exchanges.
      • Product Use & Medical Disclaimer. Products should be used according to instructions.  This Site is not a substitute for medical advice. Always consult a healthcare provider for medical concerns. Hyper Real Academy does not provide medical treatment or advice. Certain products and training offered through Hyper Real Academy are designated for professional use only. These may include tattoo pigments, machines, needles, topical agents, and training courses in permanent makeup (PMU). You are solely responsible for ensuring that you possess the appropriate licensure, certifications, or permissions as required by your local, state, or national regulatory body before using any professional-grade products or applying any training in practice.
   3. International Orders. International buyers are responsible for any customs, duties, or taxes. Ownership transfers upon our delivery to the shipping carrier.
   4. Subscription Plans (via Thinkific). Hyper Real Academy offers online educational content through the Thinkific platform. By purchasing a subscription plan, you agree to the terms and billing cycle presented at checkout. Subscription access is personal and non-transferable. You are responsible for maintaining the confidentiality of your login credentials. Subscription plans may renew automatically unless canceled before the next billing cycle. We reserve the right to change pricing or features of subscription plans at any time with appropriate notice.
   5. Digital Products. All digital products—including but not limited to practice handbooks, PDF downloads, pre-recorded training modules, and instructional resources—are final sale and non-refundable once delivered. By purchasing digital products, you acknowledge that these materials are intended for personal, non-commercial use only. Sharing, reselling, or redistributing any portion of our digital content without express written permission is strictly prohibited.
   6. Vouchers for Services. We may offer promotional or prepaid vouchers for services provided by Hyper Real Academy or its affiliates. Vouchers are subject to expiration dates and specific terms noted at the time of issue. Vouchers have no cash value and cannot be redeemed for cash or combined with other offers. Rescheduling of services booked using vouchers must follow our standard appointment policies. Lost or stolen vouchers may not be reissued.
   7. Educational Content. All educational content provided through our academy, online platform, in-person training, or associated materials is protected by copyright and intended solely for individual learning. You may not record, reproduce, or distribute this content in any form without express written consent. Enrollment in our training does not grant permission to reproduce or commercially use our educational frameworks, diagrams, slides, or terminology.
   8. Legal Cosmetic Tattoo and Body Art Practice. Hyper Real Academy does not provide legal advice. Completion of a training course does not automatically qualify you to perform PMU services in your jurisdiction. It is your responsibility to understand and comply with all applicable laws and regulations regarding the practice of PMU. Any use of products or application of techniques learned through our training without proper authorization or licensure is done at your own risk. Hyper Real Academy disclaims all liability for any harm, injury, legal action, or disciplinary consequence resulting from unauthorized or improper use of our educational materials or products. 
   9. American Academy of Micropigmentation (AAM) Board Certification. Hyper Real Academy provides training programs that may support your eligibility for certification through external accrediting bodies such as the American Academy of Micropigmentation (AAM). However, we are not responsible for the decisions made by the AAM regarding approval, denial, or revocation of board certification. Final certification is subject to AAM’s own evaluation criteria, requirements, and discretion. Enrollment in our courses does not guarantee acceptance or certification from AAM or any other external organization. You are responsible for your AAM Gold Membership renewal every two (2) years and all associated costs to remain compliant with state regulations if you are practicing in a state that requires AAM Board Certification.  
   10. Intellectual Property. All trademarks, logos, service marks, training models, curriculum, text, images, instructional content, video, and branding used on or associated with Hyper Real Academy—including RealTint® technology—are the intellectual property of Kelly Bu, Anna Sun, or the Hyper Real brand and its licensors. Unauthorized use of any part of this intellectual property, including copying, republishing, or teaching it in other programs, is strictly prohibited and may result in legal action. These rights extend to all digital and physical content produced by or for Hyper Real Academy, including any courseware or supplementary materials made available to enrolled students or licensed professionals. Your purchase or participation in any Hyper Real Academy offering constitutes acceptance of these terms.
   11. Prohibited Uses. 

Users may not:

1. • Violate any laws
   • Infringe on intellectual property
   • Transmit harmful software or data
   • Interfere with Site operation
2. User Content. Any content submitted by users may be used by Hyper Real Academy for marketing or other purposes. You retain ownership but grant us a license to use your submissions.
3. Contests & Promotions. Contests and promotions may have additional terms. Participation is voluntary.
4. Third-Party Links. We are not responsible for content or practices of third-party websites linked from our Site.
5. Privacy Policy. Please refer to our Privacy Policy for how we handle personal information.
6. Disclaimer of Warranties. The Site and Products are provided “as is.” Hyper Real Academy disclaims all warranties, express or implied, including fitness for a particular purpose.
7. Limitation of Liability. To the fullest extent permitted by law, Hyper Real Academy shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you in the past 30 days.
8. Indemnification. You agree to indemnify and hold harmless Hyper Real Academy from any claims resulting from your misuse of the Site or violation of these Terms.
9. Governing Law & Dispute Resolution. These Terms are governed by New Jersey law. Disputes shall be resolved by binding arbitration in Middlesex County, NJ. No class actions are permitted.
